Delivery Terms and Conditions

These delivery terms and conditions apply to the Luottoposti encrypted email service and the additional services included in the service, provided by TK Talous Oy. Use of the service requires the customer to register on the Luottoposti website https://fin.luottoposti.fi/ and accept these delivery terms and conditions.

1. Service Provider

(hereinafter referred to as the Service Provider)

2. Customer

Customers of the Service Provider may be either natural persons or entities operating under a Business ID (hereinafter referred to as the Customer). An individual customer must be of legal age and legally competent. For customers operating under a Business ID, the order must be signed by a person authorized to sign on behalf of the Customer. The Customer is required to read these delivery terms and conditions and their appendices and agrees to comply with them when using the Luottoposti service. The Service Provider delivers all information related to the order by email, and the Customer is therefore responsible for monitoring their email to stay informed. When registering as a Luottoposti customer on the website https://fin.luottoposti.fi/, a link will be sent to the email address provided by the Customer to complete the registration process.

3. Service Ordering

The Customer registers for the Service Provider’s Luottoposti service through the website https://fin.luottoposti.fi. The Service Provider requires the Customer to accept these terms and conditions when registering. When registering as a user of the service, the Customer must ensure that all requested information is accurate and up to date. The Customer is obliged to immediately notify customer service of any changes to their information by contacting asiakaspalvelu@luottoposti.fi. All information provided by the Customer is treated as confidential. The Service Provider complies with the EU General Data Protection Regulation (GDPR) and Finnish data protection legislation in the provision of the Luottoposti service. The Customer purchases the desired service or service package from the Service Provider’s online store and pays for the service through Paytrail’s payment processing service. After a successful order, the Customer activates the purchased service via the download link and gains access to the service.

4. Use of the Service

Use of the service requires the Customer to register on the Luottoposti website. The Service Provider independently decides whether to approve a registration and determines the terms applicable to such registration. Any right to use the service granted after registration is personal and may not be transferred to another party. The Customer is responsible for all activities carried out using their username and password and for keeping the password confidential. If the Customer’s username and password become known to an unauthorized party, the Customer must immediately notify the Service Provider by email at (asiakaspalvelu@luottoposti.fi) so that the Customer’s user account can be disabled as quickly as possible. The right to use the service remains valid until further notice. A registered Customer must comply with these terms and conditions and remains responsible for their actions and obligations arising from the use of the service, even if they later discontinue using it. The Customer’s liability for actions and obligations incurred through the use of the service does not end when the right to use the service is terminated. The Service Provider reserves the right to terminate the Customer’s access to the service if the Customer fails to comply with these terms and conditions or with applicable Finnish law.

5. Processing of Personal Data

The processing of customers’ personal data is described in the Privacy Policy, which forms part of these Terms and Conditions. The Privacy Policy is available at Privacy Policy. By using the Luottoposti service at https://fin.luottoposti.fi/, the Customer accepts the Service Provider’s Privacy Policy. The Privacy Policy remains valid until further notice. The Service Provider reserves the right to amend the Privacy Policy when necessary and will announce any changes in the Privacy Policy. By continuing to use the Luottoposti service, the Customer accepts the Privacy Policy in force at that time.

6. Price List

All Luottoposti services and service prices are available on the Price List page. All prices include the applicable value added tax (VAT). The Service Provider reserves the right to change prices and will announce any such changes on the online store website. By using the Luottoposti service, the Customer accepts the prices in force at the relevant time. The Service Provider is entitled to charge the Customer for the use of the service in accordance with the prices or orders applicable at the time of use. The Service Provider also reserves the right to modify the prices, features, and options of the service displayed in the online store.

6.1 Term and Termination of the Order

An order for an individual service becomes effective from the date the order is placed. An order for a service package becomes effective on the first day of the month in which the order is placed. The service package selected by a customer subject to invoicing will automatically renew at the end of the subscription period without separate notice, unless the subscription is terminated in accordance with the termination terms before the end of the current subscription period. Either party may terminate the agreement by providing one (1) month's written notice to the other party. The notice period begins at the end of the calendar month during which the notice of termination was delivered. The Customer must submit the termination notice in writing and send it to the Service Provider by email to asiakaspalvelu@luottoposti.fi.

6.2 Customers with Invoicing Agreements

The Service Provider invoices customers with invoicing agreements on a monthly basis according to their use of the service. Fees already paid will not be refunded if the Customer terminates the agreement during an ongoing subscription period.

7. Payment Methods

Before purchasing a service package, the Customer must be logged in to the luottoposti.fi service. The service selected by the Customer is paid for through Paytrail’s payment processing service according to the service selected in the shopping cart and using the Paytrail payment methods available at the time, prior to using the service. Once the Customer has paid for the ordered service, a receipt of the payment transaction will be sent to the Customer’s email address. The download link for activating the service will become available to the Customer after a successful payment transaction through Paytrail. 7.1 Payment Method for Invoiced Customers

Customers operating under a Business ID may subscribe to the Luottoposti service as a usage-based service invoiced by electronic invoice. The Customer agrees that the Service Provider may review the Customer’s credit information before activating the service and on a regular basis during the term of the agreement. For customers operating under a Business ID, the service may only be activated by a person authorized to sign on behalf of the Customer. Payment terms, late payment interest, and collection costs are agreed separately with each Customer.

8. Delivery Methods and Delivery Times

The Luottoposti service becomes available when the Customer’s payment has been successfully processed through Paytrail’s payment processing service or when the Service Provider has approved the Customer as an invoicing customer. The Service Provider stores Luottoposti encrypted emails and attachments for fourteen (14) days unless otherwise agreed. The Service Provider does not archive sent Luottoposti messages. Attachments remain available for download by the recipient for 14 days from the time of sending, provided that the sender has not deleted the attachments before that time. In the Luottoposti service, the time of transmission is displayed in UTC. The Customer is always responsible for ensuring compliance with the laws and regulations in force in Finland when using the Luottoposti service.

If the Customer fails to comply with these Terms and Conditions, the Service Provider has the right to block the Customer’s access to the service. If a message sent by the Customer does not reach the recipient due to a technical failure, service disruption, or Force Majeure event, the Service Provider shall not be liable for any compensation or reimbursement for inconvenience, financial loss, direct or indirect damages, or any other adverse consequences suffered by the Customer.

The Service Provider has the right, but not the obligation, at its sole discretion, to remove a registered Customer from the Luottoposti service at any time if the Service Provider considers that the Customer is in breach of Finnish law, these Terms and Conditions, or the order signed by the Customer. The Customer acknowledges and accepts that access to the service may be terminated without prior notice if the Customer has acted fraudulently or has failed to comply with Finnish law, these Terms and Conditions, or the order signed by the Customer.

9. Partners

The Service Provider has the right to use partners and/or subcontractors in the provision of the service in any manner it deems appropriate. The Customer agrees to comply with the terms and conditions of the partner when using the Luottoposti service. The partner’s terms and conditions form part of the Luottoposti Terms and Conditions. The Service Provider is entitled to offer services provided by its partners to its Customers. The Service Provider and its partners are jointly responsible for the functionality of the services, each within the scope of their respective responsibilities.

10. Complaints

Any complaint must be submitted by the Customer within seven (7) days of discovering the matter giving rise to the complaint. The complaint must be submitted in writing to asiakaspalvelu@luottoposti.fi. Our customer service will review and investigate all complaints on a case-by-case basis.

11. Information Required Under the Consumer Protection Act

A consumer customer has the right to submit a dispute between the Customer and the Service Provider to the Consumer Disputes Board for resolution. More information is available at Kuluttajariita.fi.

12. Applicable Law

The use of the Service Provider’s services at https://fin.luottoposti.fi/, these Terms and Conditions, the order, and the interpretation of the agreement formed between the parties shall be governed by the laws of Finland.

13. Dispute Resolution

Any disputes, disagreements, or claims relating to matters referred to in this document shall primarily be resolved through negotiations between the parties. If a dispute cannot be resolved through negotiation, the matter shall be settled by the District Court of Southwest Finland in the Finnish language. In the event of a dispute between the parties, the Service Provider’s liability shall be limited to the service fee charged to the Customer.

14. Acceptance of the Terms and Conditions

These Terms and Conditions are accepted by the Customer through the use of the Luottoposti service at https://fin.luottoposti.fi/. The Terms and Conditions remain valid until further notice. The Service Provider reserves the right to amend the Terms and Conditions when necessary and will announce such changes on the Terms and Conditions page. By using the Luottoposti service, the Customer accepts the Terms and Conditions and their appendices in force at the relevant time.
